Terms of Sales

1. Acceptance of Terms

By placing an order and purchasing products from Pipolino SAS (“Company,” “we,” “us,” or “our”) through our website, https://us.pipolino.com (the “Site”), you agree to be bound by these Terms of Sale (“Terms”). If you do not agree to these Terms, you should not purchase products from the Site.

2. Products and Orders

A. Product Descriptions

We attempt to be as accurate as possible in the description of our products. However, we do not warrant that product descriptions or other content on the Site are accurate, complete, reliable, current, or error-free.

B. Pricing and Availability

All prices are listed in [e.g., US Dollars (USD)] and are subject to change without notice. We cannot confirm the price of an item until you order. We do not guarantee the availability of any product listed on our Site. We reserve the right to limit the quantity of items purchased per person or per order.

C. Order Acceptance

Your receipt of an electronic or other form of order confirmation does not signify our final acceptance of your order. We reserve the right at any time after receipt of your order to accept or decline your order for any reason. If we cancel an order after you have already been billed, we will refund the billed amount.

3. Payment and Billing

A. Payment Methods

We accept the following forms of payment: PayPal. You represent and warrant that the payment information you supply to us is true, correct, and complete.

B. Sales Tax

Pipolino SAS collects and remits sales tax as required by law. The final price includes applicable sales tax.

4. Shipping and Delivery

A. Shipping Fees

Shipping and handling fees are separate charges and will be itemized during the checkout process.

B. Delivery Timeframes

Any delivery dates provided are estimates. We are not liable for any delays in shipments.

C. Risk of Loss

All products purchased from the Site are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier (F.O.B. Shipping Point).

5. Returns, Refunds, and Exchanges

A. General Policy

We accept returns and exchanges on certain products. We aim for every customer to be satisfied with their purchase. If you are not entirely happy with your order, we are here to help.

B. Return Conditions

We accept returns for refund or exchange up to 30 days after delivery, provided the item meets our eligibility criteria.

C. Eligibility Criteria

To be eligible for a return:

  • The item must be unused, unwashed, and in the same condition that you received it.
  • The item must be in its original packaging with all tags and labels still attached.
  • You must have the receipt or proof of purchase.

D. How to Initiate a Return

  1. Contact Us: To start a return, please use the contact form with your Order Number and the reason for the return.
  2. Receive Authorization: We will review your request and send you a Return Merchandise Authorization (RMA) number and instructions on where to send your package. Items sent back to us without first requesting an RMA will not be accepted.
  3. Ship Item: You are responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

6. Warranties and Disclaimers

A. Limited Warranty

We warrant that the product is free from defects in material and workmanship for a period of 1 year from the date of purchase. 

B. Disclaimer of Implied Warranties

EXCEPT FOR THE EXPRESS WARRANTY SET FORTH ABOVE, ALL PRODUCTS SOLD BY Pipolino SAS ARE PROVIDED “AS IS” WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

7. Limitation of Liability

In no event shall Pipolino SAS, its directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any product purchased using the service.

8. Intellectual Property

The Site and all content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by Pipolino SAS, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

9. Governing Law and Dispute Resolution

A. Governing Law

These Terms and any separate agreements whereby we provide you Products shall be governed by and construed in accordance with the laws of the State of Georgia without regard to its conflict of law provisions.

B. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to your purchase of products through the Site shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association (AAA) in Lawrenceville, Georgia.
